Excellent Result in Traffic Matter Involving Visibility Issues and Child Restraint
Kinloch Lawyers recently represented a client, an Asian gentleman, who found himself in a difficult situation while driving with his child in the front passenger seat. The incident, which initially appeared straightforward, quickly evolved into a case with multiple charges and potentially serious consequences.
Driving With Reduced Visibility and Child Passengers Not Seat Belt Secured
Our client was driving when he experienced visibility issues due to a fogged-up front windscreen. Despite reduced visibility out of the front windscreen, he continued driving, but soon drew the attention of police. Compounding the situation, his young child was seated in the front seat and allegedly not securely fastened in accordance with road safety regulations.
Police officers stopped the vehicle and questioned our client, during which a verbal disagreement ensued. He was subsequently charged with two offences: one relating to the obscured view through the windscreen and another concerning the improper restraint of a child passenger.

The Outcome of the Case
What was Agreed
Through careful negotiation with the prosecution, we were able to secure extensive deletions from the facts underpinning the charge surrounding driving with restricted visibility that had been brought about. This allowed our client to plead guilty to a significantly reduced version of the offence.
As for the second charge — the more serious allegation regarding the child’s safety — we entered a plea of not guilty. After reviewing the circumstances and our submissions, the prosecution agreed to withdraw the charge entirely.
Given the initial facts, this was an outstanding result. Our client avoided a conviction on the offence, this minimised the consequences, and was able to move forward without lasting impact on his character. The client was extremely pleased with the outcome and grateful for our assistance during what was a stressful time.
