Senior Figure in Organised Crime Group Avoids Prison Over Domestic Abuse Allegation
Kinloch Lawyers Represent a Senior Figure in a Serious Organised Crime Group
Being involved in one type of criminal activity doesn’t make someone guilty of others.
Kinloch Lawyers fight for the principles of fairness and justice, including avoiding undue bias or generalisation.
- If someone has a history of theft, it doesn’t mean they’re guilty of a completely unrelated crime like fraud or assault.
- Legal systems are designed to assess guilt or innocence based on evidence specific to a particular charge, not someone's past behaviour or criminal record alone.
- This is also why courts avoid prejudicial assumptions: prior convictions may not be introduced in a trial unless they’re directly relevant.
It's crucial to treat each accusation as separate and judge based on the evidence presented for that particular case.
The Allegations against our client
The Allegations and the Evidence
Our client is a senior figure in a very serious organised crime group. He was charged with a serious domestic abuse matter. He had allegedly strangled his partner and made her life a misery over 4 years. David Kinloch negotiated it down to a number of text messages sent on one day only.
The Decision of the Court
What was Agreed
In this case it was agreed that because of the insufficient evidence, our client was given a Community Payback Order instead of facing custody for up to four years.
Kinloch Lawyers Client Delighted
The client was extremely grateful to our Mr Jenkins and to the team at David Kinloch and Co for all their hard work. This case was covered in the national press. We saved him a phenomenal amount of time in Prison and due to the background, there was no non-harassment order made.
We are open for calls between 9am and 5pm only.
