Traveller with Criminal Background Not Guilty After Public Brawl

Kinloch Lawyers Client Involved in Public Brawl

Kinloch Lawyers represented a client from a travelling community with connections to organised crime.

Client did not plead even though there was compelling evidence against him

What are the implications of no plead?

A defendant might refuse to plead as a form of protest, believing the legal system is unjust or biased.

Chance of Error: Some defendants, even when evidence appears strong, might refuse to plead in the hope of uncovering a legal error or casting doubt on the evidence at trial.

Legal Rights Preservation: By not pleading guilty, the defendant exercises their right to make the prosecution prove the case beyond a reasonable doubt.

Potential Outcomes

Refusing to plead despite strong evidence is a high-risk strategy. The legal system typically favours those who cooperate early, while non-cooperation can lead to longer sentences and more complex trials. However, every defendant has the right to make this decision, and in some cases, it may reflect deeply personal or strategic reasons.

The Evidence in this case?

Our client, a senior figure in an organised crime group and part of a travelling community, was charged after a massive brawl which was filmed and posted on social media. People were seriously injured with boat hooks and machetes. The Police were called and five people were arrested. The film shows our client involved in violent acts including, kicking and damaging cars. Possibly also showing our client involved in an assault.

Not Guilty Verdict

Our client was the only accused who did not plead even though the Crown wanted us to plead, based on what they had seen on the film. Not pleading was a very astute and potentially high risk decision on the part of Kinloch Lawyers but following negotiations with the Crown, a verdict of not guilty was returned.

Kinloch Lawyers Win The Case

This was a tremendous result in the face of adversity, for our client and he is extremely grateful to our Mr Jenkins and to the team at David Kinloch and Co for all their hard work.
